
Contractor's License Bond
A contractor's license bond is a surety bond (or cash deposit) that Arizona requires a contractor to post with the Registrar of Contractors before getting licensed. It guarantees a pool of money that homeowners, suppliers, and workers can claim against if the contractor breaks the contract or fails to pay.
Before Arizona hands a contractor a license, it makes them post a contractor's license bond, the financial backstop that protects the people they work for. Under A.R.S. 32-1152, the contractor buys a surety bond from a bonding company (or leaves a cash deposit with the state treasurer) in an amount the Registrar of Contractors sets. If the contractor violates the contracting laws or breaks the contract, the people they harmed can file a claim against that bond to recover money.
The bond is a three-party promise. The contractor is the principal, the bonding company is the surety, and you (the homeowner, a supplier, or a worker) are the protected party. The contractor pays a premium for the bond, but the bond pays out to claimants, not to the contractor. If the surety pays a claim, it then chases the contractor for repayment, so the bond is not free money for the builder.
Bond amounts in Arizona scale with license type and volume. A.R.S. 32-1152 ties the figure to the work the license covers, and the ROC's schedule runs from roughly $1,000 for small specialty residential work up to $15,000 for residential general contractors, with larger commercial bonds higher. These are deliberately modest, which is the key limit owners miss.
For example, a Fountain Hills homeowner on a $600,000 build cannot expect a $9,000 license bond to cover a six-figure construction failure. That is exactly why residential contractors also pay into the Residential Contractors' Recovery Fund (up to $30,000 per residence) and why owners use lien waivers to keep suppliers from filing a mechanic's lien.
Think of the bond as the first, smallest layer of protection. It deters fly-by-night operators and covers smaller disputes, but on a custom home it is one of several tools, alongside the recovery fund, a clear contract, and ROC complaint rights, that together protect your money.
