Abandonment (Construction Contract)

Abandonment is the construction word for a contractor quitting and walking away. Arizona law treats it as a serious offense, not just a private contract dispute. A.R.S. 32-1154 lists the grounds the Registrar of Contractors (ROC) can use to suspend or revoke a license, and the very first one is "abandonment of a contract or refusal to perform after submitting a bid on work without legal excuse for the abandonment or refusal."

The key phrase is without legal excuse. A contractor who stops work because you stopped paying, or because the site is unsafe, may have a legal reason to halt. A contractor who simply stops showing up, cashes a draw, and goes silent does not. That second situation is abandonment, and it gives you a clear basis to file an ROC complaint against the builder's license.

Abandonment usually shows itself the same way: communication dries up, the crew disappears for weeks, and the work sits at a partial stage while your money is already spent. Because Arizona pays contractors on a draw schedule tied to completed phases, an abandoned job often leaves you with a half-built house and a draw or two already gone.

For example, a Casa Grande homeowner pays the framing draw, then the builder stops answering calls and never returns to start the next phase. With no legal excuse for the stoppage, the owner can file an ROC complaint citing A.R.S. 32-1154 abandonment, and, if the builder was licensed, may pursue a Residential Contractors' Recovery Fund claim for the cost to finish.

If you suspect abandonment, document everything: the contract, the payment record, the dates the crew last worked, and your attempts to reach the builder. That record is what the ROC investigates, and it is also what protects you if the dispute moves to a recovery-fund claim or court.
