IRC R327 Swimming Pools, Spas and Hot Tubs: The ISPSC and Arizona's Stricter Law

A pool is the default backyard feature on an Arizona custom home, and it is also the top drowning risk for young children in the state. IRC Section R327 is one of the shortest sections in the book. It writes no pool rules of its own. It names another code and steps aside. A state statute then overrides the barrier height that code sets, which leaves R327 carrying a narrow set of details: the ones about climbing over and squeezing through.

What R327 actually says

R327 hands the job to a separate model code. That is the whole section:

The design and construction of pools and spas shall comply with the International Swimming Pool and Spa Code.

The ISPSC carries the model barrier rules plus the rest of a pool: deck surfaces, entrapment protection at suction outlets, drains, and where the equipment pad can sit. None of that has an Arizona statute behind it, so it reaches your build only through whatever pool code your city or county actually adopted.

Where the model code stops and Arizona's statute starts

The ISPSC sets a 48 inch minimum barrier. Arizona's own pool law is taller, and it applies statewide whether or not your jurisdiction ever adopted a pool code. Barrier height, gate hardware, latch height, the safety-cover alternative, and which homes are covered at all: on every one of those the statute governs and the model number is beside the point. The climb and gap rules the code layer carries

Height is half a barrier. The rest is whether a child can get through it or up it.

No opening can pass a 4 inch ball. That single number sets picket spacing, and it is the same sphere rule the code uses for guards elsewhere in the house. A chain-link fence needs a mesh tight enough to stop the same 4 inch object.

Climbing comes down to rail placement. Horizontal rails have to sit at least 45 inches apart, far enough that a child cannot use the lower one as a step to the top. A fence that cannot meet that spacing has an alternative: put the rails on the pool side, out of reach from the yard, with gaps no wider than 1.75 inches. Solid block, the usual Valley choice, sidesteps the question because there is nothing to grab.

What it means for an Arizona custom home

For example, on a new Scottsdale home with a backyard pool, the barrier gets checked at plan review and again before final inspection. Most Valley builders use the perimeter yard wall, at least 5 feet of block, as the main barrier, then add a self-closing gate on any side access. If the design lets a covered patio open straight to the pool, the city may require a separate pool-side fence so the house doors are not the only thing between a toddler and the water. Which edition and local rules apply

R327's reference to the ISPSC is stable across the 2021 and 2024 IRC, and the 2018 IRC used a similar pool reference. What matters more in Arizona is that the state pool law applies statewide, and your AHJ can add stricter rules on top of it. How this connects to the rest of your build
